APPROVAL OF AGENDA

The commission may take action on items as part of a consent agenda at the beginning of the meeting. In these instances, the commission president will open the public hearing at the beginning of the meeting and will ask whether anyone would like to provide testimony or express concerns about items recommended for the consent agenda. 1.       Fresh Thyme Liquor Store, 2929 University Ave SE, Ward 2

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by Lakes Venture, LLC.

A.      Conditional use permit.

Recommended motion: Approve the application for a liquor store, subject to the following conditions:

1.       The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

2.       The premises, all adjacent streets, sidewalks and alleys, and all sidewalks and alleys within 100 feet shall be inspected regularly for purposes of removing any litter found thereon.

3.       The amount of windows in the liquor shall not be further reduced from what was approved in 2015.

4.       First floor or ground floor windows shall allow views into and out of the building at eye level. Shelving, mechanical equipment or other similar fixtures shall not block views into and out of the building in the area between four and seven feet above the adjacent grade.

2.       2750 Park Ave, Ward 6

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by Adna Properties.

A.      Conditional use permit.

Recommended motion: Approve the application for a conditional use permit to establish a development achievement center in the R6 district, subject to the following conditions:

1.       The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

2.       The applicant shall implement a landscaped yard of at least 7 feet along Park Ave and Oakland Ave that meets the intent of the landscaping and screening requirements of chapter 530.170

B.      Variance.

Recommended motion: Approve the application for a variance to reduce the minimum parking requirement from 19 parking spaces and 4 drop-off space to 12 parking spaces and 4 drop-off spaces, subject to the following condition:

1.       The applicant shall install 3 bicycle parking spaces that meet the definition for short term parking in order to comply with the minimum bicycle parking requirements of chapter 541.180.

3.       1715 and 1717 E Lake St, Ward 9

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by Matthew Meinholz.

A.      Rezoning.

Recommended motion: Approve the application to rezone the properties at 1715 and 1717 Lake St E from the C1 Neighborhood Commercial District to the C2 Neighborhood Corridor Commercial District.

4.       4th Street Lofts, 2813 4th St SE, Ward 2

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by Gretchen Camp of ESG Architecture & Design.

A.      Rezoning.

Recommended motion: Approve the petition to rezone the property at 2813 4th St SE from the I1 Light Industrial District to the R6 Multiple-Family District, retaining the PO Pedestrian Oriented Overlay District and the UA University Area Overlay District.

B.      Variance.

Recommended motion: Approve the variance to allow the building to be located greater than 15 feet from the front lot line along 4th St SE and greater than 18 feet along 29th Ave SE in the PO Pedestrian Oriented Overlay District.

C.      Variance.

Recommended motion: Approve the variance to reduce the minimum parking requirement from 68 to 40 spaces.

D.      Variance.

Recommended motion: Approve the variance to increase the percentage of required parking spaces that may be satisfied with compact parking spaces from 25 percent to 70 percent.

E.       Variance.

Recommended motion: Approve the variance to reduce the minimum loading requirement from 1 small space to 0.

F.       Variance.

Recommended motion: Approve the variance to reduce the minimum front yard requirement along 4th St SE from 15 feet to between 0 and 10 feet to allow the building wall, to between 0 feet and 1 foot to allow outdoor decks, to 4 feet to allow stairs exceeding 8 feet in width, and to 10 feet to allow an entrance landing exceeding 36 square feet in area, subject to the following condition:

1.       The applicant shall obtain encroachment permits from the Department of Public Works for any elements proposed within the public right-of-way.

G.     Variance.

Recommended motion: Approve the variance to reduce the minimum corner side yard requirement along 29th Ave SE from18 feet to 11 feet to allow the first floor building wall, to 0 feet to allow the building wall on floors 2 through 6, to 0 feet to allow a ground floor patio exceeding 50 square feet, to allow more than 8 bicycle parking spaces, to allow a trellis greater than 20 square feet in area and more than 8 feet in height, and to allow a walkway exceeding 6 feet in width.

H.     Variance.

Recommended motion: Approve the variance to reduce the minimum interior side yard requirement along the west property line from 15 feet to 9 feet to allow the building wall and outdoor deck.

I.        Variance.

Recommended motion: Approve the variance to reduce the minimum rear yard requirement along the north property line from 15 feet to 6 feet to allow the building wall.

J.        Site Plan Review.

Recommended motion: Approve the site plan review for a six-story residential building with 169 units, subject to the following conditions:

1.       All site improvements shall be completed by March 23, 2020, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

2.       CPED staff shall review and approve the final site, elevation, landscaping, and lighting plans before building permits may be issued.

3.       The plant materials, and installation and maintenance of the plant materials, shall comply with sections 530.200 and 530.210 of the zoning code.

4.       The applicant shall obtain a separate permit from CPED for all signage.

5.       The applicant shall submit a lighting plan that demonstrates compliance with section 535.590 of the zoning code. In addition, the applicant shall provide an exterior lighting plan to demonstrate that the project provides lighting on site, at all building entrances, and along walkways that maintains a minimum acceptable level of security while not creating glare or excessive lighting of the site.
